Welcome to gaurikohli.com. These Terms & Conditions (“Terms”) govern your use of this website and any purchase of products (“Goods”) from GAURI KOHLI LLC (“we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Definitions
   “Customer”, “you”, or “user”: Any person accessing the Site or purchasing Goods.
   “Goods”: Any products offered for sale on the Site.
   “Order”: Your request to purchase Goods submitted through the Site.
   “Site”: gaurikohli.com and its subpages.
   “Price”: The cost of the Goods including applicable taxes, duties, and shipping charges.

2. Contract Formation
   Your Order is an offer to purchase Goods under these Terms. We may accept or reject any Order.
   The contract is formed when we confirm dispatch of your Order.
   Errors in pricing or description: If we discover an error, we may cancel your Order and refund any amounts paid.

3. Pricing, Payment & Taxes
   Prices are displayed in USD (for US customers) and EUR (for EU customers) unless otherwise stated.
   US Customers: Prices may or may not include state sales tax depending on your location. Any applicable taxes will be displayed at checkout.
   EU Customers: Prices shown include VAT where legally required. You are responsible for any customs duties if applicable.
   Payment must be made in full through accepted payment methods before dispatch.

4. Shipping & Delivery
   We aim to deliver within the stated timeframe, but times are estimates, not guarantees.
   EU customers: In line with the EU Consumer Rights Directive, we will deliver your Goods within 30 days of Order confirmation unless otherwise agreed.
   Risk of loss passes to you upon delivery. Ownership of Goods transfers only after full payment is received.
   Please inspect Goods upon receipt. Any visible defects must be reported within 7 days.

5. Cancellation & Returns
   United States: Returns are accepted within 30 days of delivery for unused, undamaged Goods in original packaging. Return shipping costs are your responsibility unless the Goods are faulty or damaged.
   European Union: Cooling-off period: You have the legal right to cancel your purchase within 14 days of receiving your Goods, without giving any reason. To exercise this right, notify us in writing (email or contact form) within 14 days. You must return the Goods at your own cost within 14 days of cancellation. We will refund the full Price (including standard delivery charges) within 14 days of receiving the returned Goods. Faulty, defective, or misdescribed Goods will be replaced or refunded at no cost to you.

6. Intellectual Property
   All content on gaurikohli.com (logos, images, text, product designs, software, trademarks) is owned by or licensed to GAURI KOHLI LLC and protected under US, EU, and international intellectual property laws. You may not copy, reproduce, or distribute any part of the Site without prior written consent.

7. Limitation of Liability
   To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages.
   US Customers: We disclaim implied warranties (merchantability, fitness for purpose) except where prohibited by law.
   EU Customers: Nothing in these Terms affects your statutory consumer rights, including guarantees of conformity under EU law.
   Our liability for any claim related to Goods is limited to the purchase price paid.

8. Force Majeure
   We are not responsible for delays or non-performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions, pandemics, or government regulations.

9. Privacy & Data Protection
   Your personal information is collected and processed in accordance with our Privacy Policy (link).
   EU Customers: Data is processed under the General Data Protection Regulation (GDPR). You have rights to access, correct, erase, or restrict processing of your data.
   US Customers: Data is collected in line with applicable federal and state privacy laws.

10. Governing Law & Jurisdiction
    US Customers: These Terms are governed by the laws of the State of Delaware, USA, and disputes are subject to Delaware courts.
    EU Customers: You may bring disputes before the courts in your EU member state of residence, in accordance with EU consumer law.

11. Changes to Terms
    We may update these Terms periodically. The “Last Updated” date reflects the effective date. Continued use of the Site or purchases after updates indicates your acceptance of the revised Terms.

12. Severability & Waiver
    If any part of these Terms is found unenforceable, the rest remains valid. Our failure to enforce a right does not constitute a waiver of that right.
